Welcome to FilmTorch. By accessing or using our platform, you agree to these Terms & Conditions. Please read them carefully. If you do not agree, do not use our services.
2. Eligibility
You must be at least 13 years old to use FilmTorch. Users under 18 must have parental or legal guardian consent. Businesses and creators are responsible for ensuring all team members comply with these terms.
3. User Accounts and Service Refusal
You are responsible for maintaining the confidentiality of your account credentials. You agree to provide accurate information and update it as needed. We reserve the right to refuse service to anyone or any corporation at our sole discretion. We may suspend, terminate, or moderate accounts and content based on our judgment and in accordance with these terms. Content moderation decisions are final.
4. Content Ownership and Intellectual Property
You retain full ownership of all content, including scripts, uploaded to FilmTorch. Scripts are protected by hash verification and remain private by default. By posting public content, you grant FilmTorch a limited, non-exclusive license to display and promote it. You represent that you own or have rights to all uploaded content and will not infringe others' intellectual property.
5. Content Standards and Guidelines
FilmTorch is a professional TV and film platform. Embedded YouTube videos must be: content about yourself or your work, TV shows, web series, or full-length films. Prohibited content includes pornographic material, faceless content, and AI-generated content. This platform is designed for legitimate film and television professionals and their work. Content that doesn't meet these standards will be removed.
6. Script Protection and Access
Scripts uploaded to FilmTorch are hash-protected and private by default. You control all access permissions. Download requests require your explicit approval. FilmTorch implements technical measures to protect script integrity but cannot guarantee absolute security. You are responsible for maintaining additional backups of your work.
7. DMCA and Copyright Protection
FilmTorch respects intellectual property rights and responds to valid DMCA takedown notices. If you believe content infringes your copyright, contact us with detailed information. We will investigate and remove infringing content promptly. False claims may result in account termination.
8. Prohibited Activities
Users may not: upload illegal, harmful, or discriminatory content; infringe intellectual property; engage in abusive behavior, impersonation, or spam; attempt to hack, disrupt, or reverse-engineer the platform; circumvent payment systems; create false bookings or reviews; or use automated tools without permission.
9. User Indemnification
You agree to indemnify and hold FilmTorch harmless from claims arising from: your content or use of the platform; violations of these terms; infringement of third-party rights; marketplace transactions you participate in; or any unlawful activities. This indemnification survives account termination.
10. Pro Subscriptions and Billing
FilmTorch Pro subscriptions ($19/month) are processed through Stripe and automatically renew unless cancelled. We offer 30-day no-questions-asked refunds minus Stripe processing fees. You may cancel anytime via your account settings. Cancellation takes effect immediately. Price changes require 30 days notice.
11. Marketplace Transactions
FilmTorch facilitates connections between users but is not party to marketplace transactions. All payments, agreements, and transactions occur directly between users off-platform. FilmTorch does not process payments, hold funds, or guarantee transaction outcomes. Users transact at their own risk and must verify counterparties independently. We reserve the right to modify, add, or remove marketplace features, fees, or functionality at any time without notice. We recommend secure payment methods and written agreements for all bookings.
12. Platform Changes
We are constantly improving FilmTorch and may modify or discontinue features at any time without notice. We are not liable for any changes or downtime that may affect your use or access to the platform.
13. Third-Party Links
FilmTorch may contain links to third-party websites, including YouTube embeds and social media. We are not responsible for the content or privacy practices of these sites. Use them at your own risk.
14. Limitation of Liability
FilmTorch is provided "as is" without warranties. Our liability is limited to the amount you paid us in the 12 months preceding any claim, not to exceed $100. We are not liable for indirect, incidental, consequential, or punitive damages, including lost profits, data, or business opportunities, even if foreseeable.
15. Dispute Resolution
Disputes will be resolved through binding arbitration in Los Angeles County, California, under American Arbitration Association rules. You waive jury trial rights and class action participation. Small claims court remains available for qualifying disputes under $5,000.
16. Changes to Terms
We may update these Terms & Conditions from time to time. When we do, we will update the "Last Updated" date above. Continued use of FilmTorch after changes means you accept the new terms.
